Foreign divorce decree

A judicial document with two rules of its own: it needs a finalisation annotation before it can be certified, and it is apostilled through the judicial authority rather than the civil one.

Validity
No expiry, but Turkish records must be updated before it is relied on

A decision of a foreign court dissolving a marriage. It is one of the most frequently mishandled documents in Turkish files, and always for the same two reasons.

⭐ It needs a finalisation annotation

A decision is not usable until it shows that it has become final. That annotation is added by the court that issued the decision, on the decision itself.

Without it, apostille and translation achieve nothing, because Turkish authorities cannot act on a decision that may still be subject to appeal. Obtain the annotation first; the order is not negotiable.

⚠ A different apostille authority

Court decisions are judicial documents. In most systems they are apostilled by a judicial body rather than the authority that handles civil registry documents.

A file containing a divorce decree and a birth certificate therefore often needs two authorities in the same country. Plan for both — see which documents need an apostille.

Everything is translated

The decision, the finalisation annotation, court seals, register numbers, judges’ names and any marginal notes. A translation of the operative paragraph alone is incomplete, and incomplete files are returned.

Terms are rendered as what they are rather than converted into their nearest Turkish counterpart; whether a foreign order corresponds to a Turkish one is a legal question.

Recognition comes before use

Having the document certified and translated does not by itself change Turkish records. The divorce must be given effect here, either through a civil registry procedure or through a Turkish court.

Which applies is a legal question. See recognition of a foreign divorce.

Length and cost

Judgments can run to many pages, and parts of them may deal with matters irrelevant to the Turkish procedure. Ask your lawyer which parts are actually needed before commissioning translation of the whole document.

Divorces that were not court decisions

Some systems allow a marriage to be dissolved administratively or before a notary rather than by a court. Such a document is not a judgment, so it has no finalisation annotation and it may follow the civil rather than the judicial apostille route.

Say which kind yours is when you ask about it. The two are handled differently at almost every step, and treating one as the other wastes the first attempt.
